Appeals from probate court are tried de novo in district court. 1. On appeal to district court from an order of the probate court amending a final decree of distribution after the time for appeal from such decree had expired, the trial is de novo and, there being no pleadings in the district court, that court must determine the right to amendment upon the petition filed in the probate court and the proof in support thereof.
